The municipality considers that the conditions for procurement in accordance with the public procurement regulations § 13-4 letter b no. 2 and no. 3 are fulfilled. The basis is that competition, according to the municipality's assessment, is also due to technical reasons, and that the permits in question are connected to intellectual property rights, at the same time that the municipality has not identified alternative licences that can fulfil the joint need. The technical conditions that the municipality has emphasised are particularly: - documented cleansing effect and performance. - the necessary capacity within the very limited area. - necessary installation and mobilisation time. - the technical method that makes it mogleg to combine capacity and compact design. The municipality has assessed alternative technologies and suppliers, but has not identified other permits that can cover the need in a rhyming way under the actual conditions at the city. The lack of competition after the municipality's assessment does not mean that the municipality itself has the downhill requirement with the aim of favouring a specific supplier or technology. Krava follows objective and factual conditions at the city, particularly available area, the necessary cleaning capacity and the need to have a functioning licence established at a necessary time. The time critique is not used as a self-legal exemption basis for the procurement. It is a part of the actual conditions that determined the municipality's real and objective needs, and which means that delivery, installation and commissioning within the necessary time frame is a central part of the technical assessment.
