Bergen municipality has used the ESRI technology as a system for analysis and access purposes in the municipality ́s GIS platform. Furthermore, the technology is used to develop and maintain their own systems that, among other things, support case handling, stand-by and inhabitant inspections. These systems have been developed as the market does not offer 'off-the-shelf goods' that will cover the municipality ́s needs. Through these solutions Bergen municipality has access to the necessary information for handling critical events, e.g. for Bergen Fire Brigade, Samunnsikkerhetens hus, Bymiljøetaten and Bergen Vann. Bergen municipality will work to reduce vulnerability in the sole supplier situation and concrete work is being carried out on mapping solutions that can be replaced through competitions in the market. The services included in the new contract with Geodata AS are: ·       ESRI Enterprise License Agreement (ELA) ·       User Support/Support ·       Licensed services from Geodata as, for Norwegian adaptations. The contract will apply for the entire municipality of Bergen. The contracting authority will not enter into a contract until 10 days at the earliest after this notice has been published on Doffin/TED. Explanation as to why the contract will be signed without a competition Through the contract with GEODATA AS, Bergen municipality has access to licences and services for operation and user support for the ESRI products used to develop and adapt systems in Bergen municipality to support the provision of several critical services. The agreement with Geodata AS expires and there is a need for a further contract to ensure access to the services. As a result of the tenderer having sole right to sales of licences and license expansions for the ESRI products, it is not possible to bring in other suppliers on this software. The terms in § 13-4, letter b), alternative 3 "The procurement applies for services that only a specific tenderer can deliver because the tenderer has the sole right, including intellectual property rights" for fulfilled and that there is a legal right to hold a procurement without a competition.
