Birmingham City Council (the "Council") wishes to establish a Light Touch Open Procedure for the provision of home support for adults at approved premises and at HM Prison Birmingham. The Care Act became law in June 2014; Section 76 of the Act sets out the responsibilities for the provision of care and support for adult prisoners. Where it appears that adults in prison have needs for care and support, they should have their needs assessed by the local authority and where they meet eligibility criteria; have services provided by the local authority. In essence prisoners are entitled to receive the same access and provision of services as if they were a member of the local community. Approved Premises are residential facilities that provide supervision and support for high-risk offenders released from custody, acting as a bridge between prison and community life. The referral processes for social care will be in place from the start of the contract and individuals will also have the right to self-refer. The Council will be responsible for all prisoners who satisfy the eligibility criteria. However, where a prisoner does not satisfy the eligibility criteria then any needs will continue to be met by the Prison. The Provider shall ensure that the following aims and objectives of the service are achieved: • Enhanced quality of life for people in Prisons and Approved Premises with unmet, eligible adult social care needs; • Reduction in the need for care and support in association with appropriate agencies; • Service users have a positive experience of Care; • Safeguarding for adults whose circumstances make them vulnerable and protection from avoidable harm as set out in the Care Act; • Improvements and maintenance of an individuals’ health and wellbeing through increased independence, choice, control, dignity and quality of life; • Promotion of independence, enabling the person to be an active member of society; • Provision of a person-centred service, responsive to the needs and circumstances of individuals; • Support to maximise independence after illness or disability through working within a rehabilitation, reablement and enablement philosophy; • Provision of a high-quality service in terms of access, the individuals’ experience and outcomes based on evidence of effectiveness; • Increased levels of Service User satisfaction, enabling Service Users to have a real say in how support and services will be developed in the future, ensuring that people are at the heart of any decision that affects their life; • Provision of clear information so that people can make informed choices. The contract will commence on 1st November 2026 and will be in place for a period of 5 years with the option to extend for a further period of up to 2 years subject to satisfactory performance and funding availability. The contract will be awarded to a single provider. Please note TUPE will apply to this contract. The TUPE information will be released to you upon receipt of a signed copy of Appendix A P0866_2027 TUPE Confidentiality Agreement.
